Virginia law sets fourth the different classifications of misdemeanors and correlating punishments, which are:

• Class 1 misdemeanor: A class 1 misdemeanor is punishable by confinement in jail for not more than twelve months and a fine of not more than $2,500, either or both. Assault and battery, DUI, and reckless driving are common examples of class one misdemeanors.
• Class 2 misdemeanor: A class 2 misdemeanor is punishable by confinement in jail for not more than six months and a fine of not more than $1,000, either or both.
• Class 3 misdemeanor: A class 3 misdemeanor is punishable by a fine of not more than $500.
• Class 4 misdemeanor: A class 4 misdemeanor is punishable by a fine not more than $250.
