Misdemeanors in Virginia
Virginia has four classifications of misdemeanors which are classified based on the level of punishment. Virginia law sets fourth the different classifications of misdemeanors and correlating punishments, which are:
- Class 1 misdemeanor: A class 1 misdemeanor is punishable by confinement in jail for not more than twelve months and a fine of not more than $2,500, either or both. Assault and battery, DUI, and reckless driving are common examples of class one misdemeanors.
- Class 2 misdemeanor: A class 2 misdemeanor is punishable by confinement in jail for not more than six months and a fine of not more than $1,000, either or both.
- Class 3 misdemeanor: A class 3 misdemeanor is punishable by a fine of not more than $500.
- Class 4 misdemeanor: A class 4 misdemeanor is punishable by a fine not more than $250.
