DUI Punishments in Virginia
A DUI offender can expect certain consequences under Virginia law. These consequences increase in severity with the number of offenses, but all have the power to alter the life of the offender, as well as remain on record long after the initial charge.
The Daugherty Law Firm can help you fight these consequences, saving you time, money, and frustration, and ultimately getting your life back on track quickly and efficiently.
DUI first offense
For a first offense DUI, the maximum punishments are a $2,500 fine, one year in jail, and the revocation of your driver's license for one year. In addition, the law mandates all individuals convicted of drunk driving offenses lose their driver's license for one extra year, as well as complete the Virginia Alcohol Safety Action Program, or VASAP, for which they must pay $300 out of their own funds to attend.
DUI second offense
If you are convicted of a second DUI offense within ten years of the first, you are mandated to serve a 10-day jail sentence. If you are convicted within five years of the first offense, you are mandated to complete a 20-day jail sentence.
DUI third offense
If you are convicted of a third DUI offense within 10 years, you are mandated to serve a six-month jail sentence, while a fourth offense within 10 years calls for a one-year jail sentence.
These are only a few of the possible consequences of a DUI conviction. Your ultimate punishment depends on many factors, such as previous convictions, the judge overseeing your case, and the law firm representing you.
